Terms of service

These terms cover your use of SiteWise, job-management software for concreting and construction businesses. If a business subscribes, the business is our customer and everyone it gives a login to — office and crew — uses SiteWise under these terms.
Accounts and access
The business decides who gets a login and what role they have. Keep your password to yourself: anything done with your login is treated as done by you. Tell the business (and us, if it’s serious) as soon as you think someone else has your password.
You can delete your own login from inside the app — Settings on the office app, or the bottom of the crew screen. What that removes and what the business keeps is set out in the privacy policy.
What you agree not to do
- Use SiteWise to break the law, or to store someone’s personal information you had no right to collect.
- Try to reach another business’s data, probe the service for weaknesses without our written go-ahead, or work around access controls.
- Resell or white-label the service without our agreement.
Your data stays yours
The business owns everything it puts into SiteWise — jobs, crew records, timesheets, dockets, photos, quotes and invoices. We store and process it to run the service for you, and we don’t sell it or use it to train anything.
You can export your records while the subscription is live. If the subscription ends, ask us within 30 days and we’ll provide an export before deletion.
Where the software drafts something for you
Some features draft text from what you’ve entered — quote line items, a site summary, a daily brief. They’re a starting point, not advice, and they can be wrong. Read anything drafted before you send it to a client or rely on it. Prices, quantities and safety calls are yours to check.
SiteWise is not your lawyer, accountant or safety adviser
SiteWise helps you keep records and paperwork. It does not tell you what the law requires of your business, and using it doesn’t make you compliant on its own. In particular:
- Building contracts. A SiteWise quote is a quote. In Queensland, domestic building work over $3,300 needs a written contract that complies with the Queensland Building and Construction Commission Act 1991— including the required warnings, the Consumer Building Guide for larger jobs, and the cooling-off period. Use a compliant contract for that; don’t use a quote in its place.
- Getting paid.Progress claims created in SiteWise are a record of what you’re claiming. Whether a claim is a valid payment claim, and what a payment schedule has to say and by when, is governed by the Building Industry Fairness (Security of Payment) Act 2017 (Qld). Check the timing for your contract.
- Pay and records.SiteWise records hours and can cost them, but it isn’t payroll and it doesn’t interpret your award or EBA. Award rates, allowances, superannuation and payslips remain your responsibility.
- Licensing. Displaying your QBCC licence number, and holding the right licence for the work, is on you.
Availability
We aim to keep SiteWise running and quick, but we don’t promise it will never be unavailable. Planned work is done outside Queensland site hours where we can. Features change as the product grows; we won’t remove something you rely on without telling account holders first.
Fees
A business that signs up on the website gets a free trial of 14 days. No card is taken for the trial and nothing is charged when it ends; the business keeps using SiteWise by choosing a plan.
Plans are billed in advance, monthly or yearly, at the price shown on the pricing page when you subscribe. Prices are in Australian dollars and exclude GST, which is added to each payment; every payment comes with a tax invoice. A plan renews automatically at the end of each period until it’s cancelled. You can cancel any time from Settings → Billing, and access continues to the end of the period already paid for. If we change the price, we’ll tell account holders at least 30 days before it applies to a renewal.
A business with its own written agreement with us (for example, one invoiced directly by Wise AI) is billed on that agreement’s terms instead. If a payment fails we’ll tell you before access is affected.
SiteWise is sold to businesses directly, on the website or by Wise AI. Nothing is bought inside the app: the iPhone and iPad app is a way for a subscribed business and its crew to use what the business already pays for, and no purchase, subscription or upgrade is offered through Apple.
Who we are
SiteWise is owned in equal shares by Wise AI Solutions and Bruce Smith Concreting. Wise AI Solutions operates the service, issues the invoices and is the party you contract with under these terms. Bruce Smith Concreting uses SiteWise under the partnership and is not your supplier.
Liability, and what the law says we can't limit
Nothing in these terms excludes, restricts or modifies the consumer guarantees or other rights you have under the Australian Consumer Lawthat cannot lawfully be excluded. Where we’re allowed to limit our liability, our total liability for any claim is capped at the fees you paid us in the 12 months before it arose, and we’re not liable for indirect or consequential loss — including lost profit, or loss caused by inaccurate information you or your people entered.
You remain responsible for the accuracy of what goes into SiteWise, and for the decisions you make from it.
Ending it
You can stop using SiteWise at any time; the business can cancel per its agreement with us. We can suspend access if an account is being used in a way that breaks these terms or puts other customers at risk — we’ll tell you why, and give you a chance to fix it unless the risk is immediate.
Which law applies
These terms are governed by the law of Queensland, Australia, and the courts of Queensland have jurisdiction.
